Terms & Conditions

A booking is confirmed only when we have received your completed booking form and the required deposit. Places are allocated in order of receipt; we cannot hold a place without a deposit. Group sizes are deliberately small, and expeditions regularly fill, so early booking is recommended.

Once your booking is confirmed, we will send you a welcome pack with the full itinerary, packing list, arrival logistics and a rider questionnaire. It is your responsibility to provide accurate information on this questionnaire, including your riding experience, licence details and any medical conditions.

A non-refundable deposit of 25% of the expedition price is due at the time of booking. The remaining balance is due no later than 60 days before the expedition start date. If the balance is not received by that date, we reserve the right to treat the booking as cancelled and apply the cancellation terms in Section 3.

All prices are quoted in US dollars (USD) unless stated otherwise. Prices are guaranteed once your deposit is paid. Where a booking is made within 60 days of departure, the full amount is due at the time of booking. Accepted payment methods include bank transfer, credit card and other methods confirmed at the time of booking. Any bank or card processing fees are the participant's responsibility.

If you need to cancel, you must notify us in writing by email to [email protected]. Cancellation charges apply from the date written notice is received:

• More than 90 days before departure: full refund minus the deposit.
• 60–90 days before departure: 50% of the expedition price refunded.
• 30–59 days before departure: 25% of the expedition price refunded.
• Less than 30 days before departure, or failure to join the expedition: no refund.

The deposit is non-refundable in all cases, as it covers bike reservation, permits and guide scheduling. We strongly recommend comprehensive travel insurance that includes trip cancellation cover, so that you can recover costs if you must cancel for an insured reason.

If The Whispering Trails must cancel an expedition — for reasons such as insufficient bookings, guide unavailability, or force majeure — you will receive a full refund of all monies paid, or the option to transfer your booking to another expedition of equal value. Our liability in this case is limited to the amount you paid us; we are not liable for flights, visas or other personal costs.

Our expeditions are genuine off-road adventures, and every rider must meet the following requirements:

• Minimum age of 21 years at the start of the expedition, and a full, valid motorcycle licence held for at least 2 years.
• Prior off-road or enduro riding experience appropriate to the expedition grade. If you are unsure whether an expedition suits your level, contact us before booking — we will help you choose honestly.
• Reasonable physical fitness. Days can be long, hot and demanding, and remote sections may be hours from medical facilities.
• Sufficient travel insurance that covers off-road motorcycling, including emergency medical treatment and repatriation. Proof of insurance may be requested before departure.
• No alcohol or impairing substances before or during riding days. We reserve the right to dismiss any rider whose conduct endangers themselves or the group, with no refund.

Participants are responsible for ensuring their passport is valid, and for obtaining any visas required to enter Guatemala. We are happy to advise but cannot be held responsible for entry refusals.

Unless otherwise stated, expeditions include the use of a late-model enduro motorcycle (KTM or Husqvarna), fuel, and basic maintenance during the ride. Bikes are provided in good condition and must be treated with care.

A refundable damage deposit may be required before the expedition starts. Participants are liable for the cost of repair or replacement of parts damaged through crashes, drops or negligence beyond normal wear and tear. Loss of keys, equipment or documents issued to you will also be charged at cost.

Off-road motorcycling in remote mountain, jungle and volcanic terrain is an inherently risky activity. Risks include — but are not limited to — collisions, falls, mechanical failure, altitude, weather, wildlife, rockfalls, river crossings and the absence of immediate medical care. By joining an expedition, you voluntarily accept these risks.

The Whispering Trails and its guides, staff and contractors accept no liability for death, personal injury, illness, or loss of or damage to personal property, except where such liability cannot be excluded under applicable law. Nothing in these terms excludes liability for gross negligence or wilful misconduct.

Before the expedition begins, every participant must sign a liability waiver and assumption-of-risk agreement. Riding outside the guided group, ignoring guide instructions, or riding under the influence voids our responsibilities towards you for the consequences of that conduct.

We plan every route with care, but conditions on the ground can change. Weather, road closures, landslides, mechanical issues, or events beyond our reasonable control (including natural disasters, civil unrest, strikes and government restrictions) may force us to alter routes, accommodation or timings. Where this happens, we will provide a comparable alternative wherever possible. Such changes do not entitle participants to refunds or compensation.

Guides regularly photograph and film expeditions. By joining a ride you grant The Whispering Trails a royalty-free, worldwide licence to use images and video in which you appear, for our website, social media and marketing, unless you notify us in writing before the expedition that you prefer not to appear.

These Terms & Conditions are governed by the laws of the Republic of Guatemala, and any dispute arising from them or from your booking shall be subject to the exclusive jurisdiction of the courts of Guatemala.
